Terms
and Conditions
This
agreement sets out the Terms And Conditions applicable
to the users of our services at MacLance.
All people who apply to use the services on this site
(referred to as members) must agree to all the Terms
And Conditions detailed below. In the event
that a member does not comply with all the Terms and
conditions detailed below we then have the right
to cancel a Member from participating in our services
along with closing the members account with MacLance
and/ or may withhold any payments owed to that
user that were obtained through this site.
MacLance
reserves the right to have complete discretion as
to whether or not it accepts a particular applicant or
website for participation in the service.
ELIGIBILITY
REQUIREMENTS
MacLance shall have absolute discretion as to whether
or not it accepts a particular applicant or site for
participation in the service.
REMOVAL FROM NETWORK
MacLance reserves the
right to deactivate and remove any member/ site without
prior notification, this is not only for members/
sites that it feels are in violation of our Terms
and Conditions.
If we remove a member/
site that has not breached our Terms and Conditions,
then all outstanding payments to that member/ site
will be paid before the account is closed. In
the event that a member/ site has broken the Terms
and Conditions then we reserve the right to cancel
that members/ sites account withhold that members
payments.
Any members/ sites that
are cancelled for reasons other than in breach of
the Terms and Conditions, will be entitled to receive
any payment that is due from MacLance.
REFERRAL
COMMISSIONS
The referral commission
rate is listed on the Affiliate Commission page.
If the commission rate is changed, all members will
be notified 30 days prior to the new rate being implemented
and all commissions will be at the old rate until
the full 30 days are up.
We encourage you to notify
as many people that you can which you think will benefit
from this site. You may not refer yourself nor
can you create multiple accounts to collect the referral
fees. MacLance reserves the right to hold/ cancel
any payments owed to any affiliates that it feels
are unlikely to pay any fees that it has been charged.
PAYMENTS
All payments are in USD
(United States Dollars). If a member requests
a payment by cheque, the amount must be for at least
$30, which also applies to the Paypal service.
If MacLance suspects that a source of funds is coming
from fraudulent means then it reserves the right to
cancel/ suspend any withdrawal without notification.
COPYRIGHTS
No material may be transmitted
to this site that is not owned by the member that
is sending it. All copyrighted material of any
sort is banned from this site and any user that is
caught breaching this condition will not only risk
their account being terminated but we will also notify
the owner of the copyrighted material to notify them
of your crime.
MODIFICATIONS TO THESE
TERMS AND CONDITIONS
We
may amend this agreement at any time by posting the
amended terms on this page and will also notify the
changes by email, however any changes will not come
into effect until thirty days after the notification
of the changes.
OWNERSHIP
Members agree that all information contained on a
website operated by MacLance, and all information
compiled by MacLance through operation of the affiliate
program, is the proprietary information of MacLance.
Personal information provided by members to MacLance
will be kept confidential and will not be distributed
to any third party.
E-MAIL
ADDRESSES
Members
agree to only enter their email details during the
signup process on this site. No member should
find it necessary to share their contact details nor
is it permissible. If you require to contact
someone then you can send a message direct to them
in the message board. The above also applies
to ALL forms of communication (AIM, ICQ, MSN Messenger,
Phone etc...).
PROVIDING
CONTACT INFORMATION
You are prohibited from making direct contact with
another member, unless it's for a project you
(a Provider) have been picked for, or you (a Buyer)
have picked a Provider for. This includes giving out
your e-mail address, ICQ number, phone number, or
any other method of contact outside of this site.
MacLance provides you with message boards, which should
be sufficient for pre-project planning. The only exception
to this is on "Featured" projects. If a
project has the "Featured" graphic on it,
that means the Buyer has paid a flat fee in advance,
and you ARE allowed to provide contact information
in the message board. Note that the MacLance system
does not distinguish between featured and non-featured
message board posts, so you will still get a warning
when submitting an e-mail address, even if the project
is featured.
AVOIDING
COMMISSIONS
You
are not permitted to negotiate commissions direct
with any member outside of MacLance while the Project
is Open. This also applies if a project is cancelled
without a Provider being chosen. It is the responsibility
of both parties to notify MacLance if the project
amount increases above the bid amount after the project
is closed. Any member/ site that pays/ receives
commission higher than that stated in the project
and does not notify us, will be considered as trying
to avoid paying commissions. We have some of
the lowest commissions for sites of this type and
rely upon them to continue the maintenance,
improvements and publicity of this site.
BIDDING
Providers
can place any bid on projects, however they are not
permitted to constantly re-submit bids altering the
bid amount. (Please do not do this more than
twice).
There
is to be no abnormal bidding, i.e. hourly, daily etc.
on non-featured projects.
FEATURED
PROJECTS
These
are the terms and conditions that are exclusive to
Featured Projects ONLY.
There is no commission
to pay on a featured project either by the Provider
or the Buyer as a set fee has already been paid
providing that the project bid is $1,000 or less.
Any featured project bid that is accepted above this
amount will be subject to the standard 5% fee (only
to the amount that is above $1,000).
ADVERTISING
There
are to be no URL's entered anywhere on this
site either in bids, profiles or the message boards
unless they relate to a given project (you are not
permitted to advertise your own website(s) on MacLance).
THE
ROLE OF MacLance.com
We
provide our services to allow Buyers and Providers
to communicate and help each other solve problems
and receive help on projects. We do not nor
are we able to verify the legality, reliability, accuracy
or safety of any details posted on our system by its
users. This also includes the qualifications
and skills that any member may claim to have.
We recommend that you definitely must never make complete
payments before any given project is completed to
your satisfaction and that you apply common sense
and good judgement when dealing with other members
on this site. You must read our project guidelines
and agree to them before taking part in any project.
We cannot and will not
refund any monies that you have sent to someone as
YOU are responsible for your own transactions.
In the unlikely event that you are unsatisfied with
another member then please contact us giving complete
details of the complaint and we will do our best to
resolve it. (In cases we feel a member has deliberately
tried to deceive another member either by providing
false information or not completing a project to the
details that have been arranged between the Buyer
and Provider, we reserve the right to cancel that
members account, without notification.)
